In conventional car financing, paying off an auto loan early triggers an “early settlement penalty.” In Islamic banking, however, an Ijarah or Diminishing Musharakah contract cannot legally charge compound back-interest or penal interest. Instead, early termination is governed by Shariah contract rules using an Early Purchase Price / Buyout Price mechanism.
If you financed a car through BankIslami Auto Finance (Ijarah / Diminishing Musharakah) and want to clear the facility before your 3-year or 5-year tenure concludes, here is how the buyout price is calculated, the contractual charges involved, and the steps to secure your vehicle title.
Islamic Contractual Basis of Early Termination
Under BankIslami’s Auto Finance structure, the bank and the customer enter a co-ownership or lease arrangement. When you opt to terminate early, you are exercising your right under the Undertaking to Purchase Musharakah Units:
- No Conventional Prepayment Penalty: The bank cannot compound interest for unexpired future months.
- Mutual Buyout Price: The customer agrees to purchase the bank’s remaining ownership share in the vehicle at an agreed terminal buyout price.
- Immediate Rent Cessation: As soon as the buyout settlement amount is deposited, monthly rental payments stop permanently.
The Buyout Price Formula
BankIslami calculates the final payoff amount using a defined Shariah-audited cost structure:
$$\text{Total Payoff} = \text{Remaining Principal} + \text{Early Purchase Price} + \text{Adjustments} – \text{Refunds}$$
| Component | How It Is Determined |
| Outstanding Unit Price (Principal) | The remaining balance of the bank’s investment units in the asset. |
| Additional Early Purchase Price | Contractual percentage (typically 5% to 8% of the outstanding unit balance). |
| Uncovered Takaful Premium | Any remaining unpaid portion of the annual Islamic comprehensive Takaful pool contribution for the operational year. |
| Tracker & Registration Adjustments | Any unrecovered amortized cost of GPS tracking devices or initial registration borne by the bank. |
| Security Deposit Adjustment | Your initial advance security deposit/down payment is adjusted against this total payable figure. |
(Note: Repeat customers or clients qualifying under promotional customer loyalty segments often receive a 50% waiver on the additional purchase price during early settlement).
Step-by-Step Early Settlement Process
- Request a Settlement Quote: Visit your home branch or submit an official request via BankIslami’s customer care desk for a “Premature Termination / Early Buyout Quotation”.
- Review Breakup Statement: The bank generates an itemized settlement slip valid for a specific number of days (usually 7 to 14 days), breaking down the exact principal units, purchase price, and Takaful balances.
- Deposit Cleared Funds: Deposit the exact quoted settlement amount into your linked repayment account.
- Sign the Sale Deed / Hiba Execution: Sign the final termination of Ijarah / purchase of Musharakah units deed to officially transfer full title into your name.
- Collection of Security Documents & NOC: The bank releases:
- Original registration book / smart card.
- Signed Excise Form F (Transfer Deed).
- Official Bank Clearance No Objection Certificate (NOC) addressed to the Motor Registering Authority (Excise & Taxation Department).
- Unused post-dated cheques (PDCs) submitted at account opening.
How Total Loss or Stolen Vehicle Scenarios Are Handled
If your car is stolen or damaged beyond repair (total loss), the settlement process differs from voluntary termination:
- Rent Stops Instantly: The moment an incident report (FIR) is verified, monthly rent billing ceases because the asset’s usufruct is destroyed.
- Shared Takaful Settlement: The claim is settled directly through the panel Takaful operator (e.g., Jubilee Islamic, Adamjee Window Takaful, TPL Takaful).
- Shortfall Sharing: Unlike conventional leasing where the user absorbs all residual loss, under Shariah rules, any gap between the Takaful recovery and asset value is shared proportionately between the bank and the client based on ownership equity at that date.
Excise Department Action (Removing the Lien)
Receiving your bank NOC is not the final step. You must finalize the de-hypothecation at the Excise Office:
- Present your original CNIC, vehicle smart card, and BankIslami NOC to your local Excise & Taxation Office.
- Pay the statutory government cancellation fee.
- Obtain an updated computerized registration card that removes the “Hypothecated to BankIslami” stamp, granting you clean, unencumbered ownership.
